These Terms & Conditions govern the services, products, educational materials, and other offerings provided by Datum Aeronautics, LLC ("Datum Aeronautics," "Datum," "we," "us," or "our").

By requesting, purchasing, scheduling, participating in, or otherwise using any services provided by Datum Aeronautics, you ("Client," "Student," "you," or "your") acknowledge that you have read, understood, and agree to these Terms & Conditions.

These Terms & Conditions apply together with any applicable service-specific terms, quotes, invoices, enrollment agreements, or other written agreements between Datum Aeronautics and the Client. If a specific written agreement conflicts with these Terms & Conditions, the specific written agreement will control to the extent of the conflict.

1. Scope of Services

Datum Aeronautics provides aviation education and related professional services, which may include:

  • Flight instruction;

  • Ground instruction;

  • Flight reviews and other pilot proficiency training, as applicable;

  • Aviation seminars and educational presentations;

  • Aviation-related educational materials and resources; and

  • Life insurance education and services provided by a properly licensed insurance producer.

The specific services provided, applicable rates, estimated duration, and other terms may vary depending on the Client's needs and will be communicated before or during the engagement.

Datum Aeronautics reserves the right to decline or discontinue a service when, in its reasonable judgment, doing so is necessary for safety, regulatory compliance, professional standards, scheduling, aircraft availability, or other legitimate business reasons.

2. Payment Terms

Unless otherwise agreed in writing, payment for services is due upon receipt of an invoice.

Accepted payment methods may include credit card, electronic payment, check, or other methods designated by Datum Aeronautics.

The Client is responsible for all charges associated with services that have been requested, scheduled, or provided, including applicable aircraft rental, simulator, testing, examination, facility, or third-party fees when those costs are not included in Datum Aeronautics' stated rate.

Quoted or estimated costs are not guaranteed unless expressly identified in writing as a fixed price.

Datum Aeronautics reserves the right to require payment before providing services or to suspend future services when an account is past due.

3. Scheduling, Cancellation, and No-Shows

Flight and ground training appointments are scheduled based on instructor availability, aircraft availability, weather, and the Client's needs.

Clients are encouraged to provide as much notice as possible when canceling or rescheduling an appointment.

A cancellation or rescheduling fee may apply when an appointment is canceled with insufficient notice or when a Client fails to appear for a scheduled appointment. Any applicable cancellation policy or fee will be communicated to the Client at the time of scheduling or booking.

Weather, aircraft maintenance, instructor availability, air traffic, airport conditions, regulatory requirements, or other circumstances beyond Datum Aeronautics' control may require an appointment to be delayed, rescheduled, or canceled.

When an appointment is canceled for safety or operational reasons by Datum Aeronautics or the instructor, the Client will not be charged for flight instruction that was not provided. Third-party charges may be subject to the policies of the applicable third party.

4. Flight Safety and Instructor Authority

Safety is the highest priority in all flight instruction and aviation activities provided by Datum Aeronautics.

The instructor retains sole professional authority to determine whether a flight, maneuver, training activity, endorsement, or other instructional activity can be safely and appropriately conducted under the circumstances.

Factors considered may include weather, aircraft condition, aircraft performance, pilot proficiency, fatigue, medical or physical condition, airport conditions, air traffic, operational limitations, regulatory requirements, and other applicable risks.

A Client may not require or pressure an instructor to conduct an operation, maneuver, flight, or training activity that the instructor determines is unsafe, inappropriate, or inconsistent with applicable regulations or professional standards.

The instructor may terminate or modify a training flight at any time when, in the instructor's judgment, continuation would create an unacceptable safety risk.

5. Aircraft Ownership, Rental, and Operation

Unless expressly stated otherwise in writing, Datum Aeronautics does not own, operate, lease, or maintain aircraft used for flight instruction.

Aircraft used for training may be provided by a flight school, aircraft owner, aircraft rental provider, flying club, or other third party.

The aircraft owner or operator is responsible for aircraft maintenance, airworthiness, insurance, dispatch, and operational matters within that party's responsibility.

Datum Aeronautics does not guarantee the availability, condition, performance, or continued availability of any particular aircraft unless expressly agreed in writing.

Aircraft rental charges, fuel charges, instructor charges, landing fees, tie-down fees, overnight fees, simulator fees, and other third-party costs may be charged separately from Datum Aeronautics' instructional fees.

The Client is responsible for complying with the rules, policies, rental agreements, membership agreements, and operational requirements of any aircraft owner, operator, flight school, or flying club providing an aircraft.

6. Training Progress, Endorsements, and Certification

Flight and ground instruction are educational services intended to help a pilot develop the knowledge, skills, judgment, and proficiency necessary to meet applicable FAA requirements and personal aviation goals.

Completion of training does not guarantee:

  • Successful completion of an FAA knowledge test;

  • Successful completion of an FAA practical test;

  • Issuance of a pilot certificate, rating, or endorsement;

  • Completion of training within a particular number of hours;

  • Achievement of a particular proficiency level by a particular date; or

  • Any particular employment, insurance, or aviation outcome.

Training requirements and progress vary by individual.

Where applicable, instructor endorsements will be provided only when the instructor determines that the applicable regulatory and training requirements have been satisfied. FAA regulations and guidance establish requirements for instructor endorsements and training documentation.

An instructor may require additional training or proficiency beyond a minimum regulatory requirement when reasonably necessary to ensure that the Client is adequately prepared for the requested activity, endorsement, or practical test.

A recommendation for an FAA practical test or other evaluation is not a guarantee of successful completion.

7. Professional Services and Educational Guidance

Datum Aeronautics may provide aviation-related educational, consulting, or professional guidance based on information available at the time the service is provided.

Such guidance is educational in nature and is not a substitute for applicable FAA regulations, official FAA guidance, aircraft-specific documentation, operating limitations, insurance requirements, or advice from an appropriately qualified professional.

The Client remains responsible for making final decisions regarding the operation of an aircraft, pursuit of a certificate or rating, and compliance with applicable laws, regulations, aircraft limitations, and operating requirements.

For insurance services, Datum Aeronautics provides life insurance guidance and services only within the scope of applicable licensing and appointment requirements.

Datum Aeronautics does not represent itself as an aircraft insurance broker or aircraft insurance agency unless expressly stated otherwise.

8. Digital Products and Educational Materials

Any presentations, handouts, documents, study materials, templates, checklists, graphics, written content, videos, or other educational materials provided by Datum Aeronautics remain the intellectual property of Datum Aeronautics or their respective licensors unless otherwise stated.

Unless expressly authorized in writing, materials provided for personal educational use may not be:

  • Resold;

  • Redistributed;

  • Reproduced for commercial purposes;

  • Published online;

  • Modified and represented as the Client's own work; or

  • Used to provide competing commercial services.

A Client may retain copies of materials provided specifically for the Client's personal educational use, subject to these restrictions.

9. Refunds and Credits

Refund eligibility depends on the nature of the service purchased.

Services that have already been performed are generally non-refundable.

For prepaid services that have not yet been performed, refunds or credits may be considered on a case-by-case basis, subject to any applicable service-specific cancellation policy.

Third-party fees, aircraft rental charges, examination fees, testing fees, facility charges, or other costs paid to third parties may not be refundable by Datum Aeronautics.

Any refund will be issued only to the original payment method unless otherwise agreed.

Datum Aeronautics reserves the right to issue credits instead of refunds when appropriate.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Datum Aeronautics, LLC and its owners, instructors, contractors, agents, and representatives shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the services provided.

To the fullest extent permitted by law, Datum Aeronautics' aggregate liability arising from a particular service or engagement shall not exceed the amount actually paid by the Client to Datum Aeronautics for that specific service giving rise to the claim.

Nothing in these Terms & Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

11. Assumption of Risk and Aviation Activities

The Client acknowledges that aviation and flight training involve inherent risks, including but not limited to aircraft mechanical failure, weather, turbulence, air traffic, airport conditions, pilot error, judgment errors, emergency situations, and other hazards inherent in aviation.

The Client voluntarily participates in aviation activities with knowledge of the inherent risks associated with those activities.

Nothing in these Terms & Conditions is intended to eliminate or waive any duty that cannot legally be waived, nor does it relieve any party from complying with applicable federal, state, or local law or aviation regulations.

The Client is responsible for promptly informing the instructor of any condition, limitation, medication, fatigue, impairment, or other circumstance that could reasonably affect the Client's ability to safely participate in flight training.

12. Intellectual Property

The Datum Aeronautics name, logo, branding, website content, written materials, graphics, photographs, educational content, presentations, and other original materials are the property of Datum Aeronautics, LLC or their respective owners and are protected by applicable intellectual property laws.

No license or ownership interest is granted to the Client except for the limited personal-use rights expressly provided in these Terms & Conditions or in a separate written agreement.

The Client may not use the Datum Aeronautics name, logo, branding, or other intellectual property for commercial purposes without prior written permission.

13. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent that applicable federal law or aviation regulations control.

Any dispute arising from or relating to these Terms & Conditions or services provided by Datum Aeronautics shall first be addressed through a good-faith effort by the parties to resolve the matter informally.

If a dispute cannot be resolved informally, the parties may pursue any remedies available under applicable law.

Nothing in this section limits a party's right to seek emergency or injunctive relief where such relief is otherwise available under applicable law.

Colorado law provides the general legal framework for contracts and business relationships in the state, subject to applicable federal law and specific statutory requirements.

14. Acceptance of Terms

By submitting a service request, scheduling an appointment, making a payment, participating in training, purchasing educational materials, or otherwise engaging Datum Aeronautics for services, the Client acknowledges that the Client has had an opportunity to review these Terms & Conditions and agrees to be bound by them.

If any provision of these Terms & Conditions is determined to be invalid, unenforceable, or contrary to applicable law, that provision shall be interpreted or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Datum Aeronautics reserves the right to update these Terms & Conditions from time to time. The version in effect at the time a service is purchased or scheduled will generally apply to that service unless otherwise agreed in writing or required by law.
